Terms and Conditions of trading. Vroom By The Sea Limited t/a The Cafe Racer.
These Terms & Conditions of Trading apply to all Consumer contracts between Vroom By The Sea Limited t/a The Cafe Racer and our Subcontractors (“us/we/our”) and the Customer (“you/your”) in relation to the sale of goods made via the Internet or Telesales. Separate Terms & Conditions apply for all orders placed in or via our shop and trade accounts.
We accept the following payment types. Mastercard, Visa, Solo, Switch, Maestro and American Express along with Apple Pay and PayPal. Your personal details will be encrypted by 128-bit industry standard secure sockets along with an extended validation SSL for added security (you will see a lock and the address bar will turn green) so you can shop with confidence.
All transactions are carried out in GBP. Our currency convertor should be used as a guide only and the exchange rate is updated daily at 0:00 GMT. We are not responsible for any local bank charges you may be charged for any transactions.
At times our payment Gateway may ask for additional security information, we will contact you directly should this be required. The Contract shall not be completed until we have received the relevant payment into our account and any additional security has been concluded.
Prices and products are subject to change without notice and include VAT, where appropriate, at the prevailing rate and all Orders have 100% of the total order value taken at the point of order.
All of our prices are displayed with UK VAT (except for motorcycle helmets which are not subject to UK VAT). VAT is not payable on orders placed from outside of the UK and this will be deducted during the checkout process or when you choose your local currency.
Orders placed from EU countries will be subject to their local VAT, import duties and disbursements and are payable directly to the Courier before delivery can be made. This is clearly stated on your order confirmation and we seek to obtain your acceptance of charges before we despatch the order. In the event you do not pay the charges the order will be returned to us and any/all costs incurred will be deducted from your refund amount.
Time is not of the essence in these Terms and Conditions of Trading. We will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances.
We endeavour to deliver to you within 5 working days*, overseas orders may take longer. Working days (and our business opening times) are Monday to Friday, excluding UK Bank/Public Holidays.
We hold a comprehensive selection of stock with us in Shoreham however some items may be supplied from our Supplier stock. We will contact you only if we feel this will adversely affect the supply time to you*.
All standard UK (mainland) orders over £50 are delivered free of charge, under this value we charge you £4.92. All UK deliveries are sent on an overnight service from us. We are not liable for any delays which may occur for reasons beyond our control.
For deliveries outside of mainland UK and overseas, please select your location on our checkout page and the applicable delivery charge will be displayed. When goods are purchased outside of the UK, it is your responsibility to pay any locally imposed taxes and/or duties.
We will deliver only to the address stated on the purchase order and all deliveries will need to be signed for. We do not allow any changes to the delivery address or the ability for you to elect a ‘safe place’ for delivery once the order has been dispatched by us.
The provision of this clause applies in addition to your statutory consumer rights in relation to faulty or miss-described goods. These rights are not affected by the guarantee and for the purpose of this the Guarantor is Vroom By The Sea Limited t/a The Cafe Racer. Guarantees may not be transferred. The provision of this Clause 3 applies in addition to your statutory consumer rights in relation to faulty or miss-described goods. These rights are not affected by the guarantee. All items carry a one year guarantee unless stated otherwise on an individual item.
Any issues should be reported to email@example.com and we will work with you on a resolution. Upon proof of fault we will endeavour to repair the goods free of charge. If a repair is not possible you will be offered a replacement to the same value and only if a suitable replacement is not available will you be offered a full or partial refund depending on the age of the goods.
Slight surface imperfections are typical to the natural leathers used in our products and should not be considered as defects.
All Parts supplied are done so with the understanding they will be fitted by a qualified experienced person equipped with relevant tools and test equipment to facilitate fitment and ensure correct operation. When making a claim for such items please provide an invoice from the fitter of the part in question. Please note that when fitting electrical parts these can be damaged by the same faulty electrical system that caused the initial failure and in such circumstances these parts cannot be returned for refund.
Due to the varying nature of motorcycles all descriptions given for parts are for reference only and are not a guarantee of their suitability for any specific motorbike.
These guarantees do not cover fair wear and tear, neglect, abuse or misuse of your goods, loss or damage (including rusting or corrosion) due to unreasonable exposure to water, heat or weather; loss or damage due to fire, smoke, explosion, lightning, sunlight, or theft, or accidental damage or loss caused by a third party.
We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered goods over and above the value of the goods themselves. This does not affect your statutory rights.
We offer a 365 day returns policy (from the date of order) if you change your mind. If you wish to return the goods under this policy it is your responsibility to take good care of the products when trying them on and you are liable for any loss or damage. Failure to take reasonable care may result in a claim made against you and we reserve the right to deduct monies to cover any issues with returns. You should take specific care of helmets when trying them on. Do not attach goggles, remove visor film or labels until you are satisfied with the fit. Footwear should be tried indoors and on carpeted floors. Care should be taken when trying on clothing to avoid marking any products.
All items returned under this policy must be unworn, unused and still have all of the relevant original packaging such as boxes, protective film, tags and labels in place. Any and all free items, bags, armour, jacket covers etc. must also be returned.
Please return to us using appropriate, robust outer packaging to protect the products. Do not (example) stick a returns label on a shoe or helmet box and ensure you complete the returns note. Failure to comply with these instructions will mean we are unable to refund and you will be responsible for the shipping cost of returning to you.
When goods are returned from outside of the UK the package and associated documentation must be clearly marked ‘British returned goods of outbound.. then add the original Carrier name and tracking number’. You can find this information on the original order information you would have received. This should ensure any original customs charges are taken into consideration. Failure to do so will result in our refusal to accept the return and in any event you are liable to pay all Customs charges.
All items remain your responsibility until received safely by us regardless of the returns method used including the use of our free returns service (if applicable to your order) and you must use a ‘sign for’ service.
Upon receipt of your returned items we will review them to ensure it is in saleable condition (including all original packaging). During these times we hold returns for 48 hours before processing. If accepted by us we will process your refund as soon as possible, minus any pre-paid delivery charges and it will be credited by the same method of payment. In any event this will be no later than 14 days from receipt.
Strictly no returns on trade/business orders, these are defined by means of purchase or delivery of products to a business address.
Overseas refunds will be paid at the same rate as we received into our system, regardless of the exchange rate on the day of exchange.
We reserve the right to substitute free gifts if the advertised gift is temporarily unavailable. Free gifts are not applicable to discounted or sale items.
If any purchases are returned for refund, any free gifts you received with the original order must also be returned unused, unopened and fully resalable. If they are not returned or are returned unsalable their full retail value will be deducted from any monies that are refunded to you.
Promotional codes are applicable per order, you cannot use several codes for one order. They cannot be used on discounted, sale items, Beeline Moto, Motogadget, MCS, Helstons, John Doe, Belstaff Long Way Up collections, books and gift cards. The code cannot be used retrospectively.
The UK Price Beat by 10%’ is only valid on items that adhere to the following criteria:
The item must be exactly the same as you have seen elsewhere (exact model, size and colour) with a price that is at least £1.00 (GBP) less than ours and in stock with a Retailer in the UK.
The Retailer must be an authorised dealer for the brand and sell genuine goods.
Items must be brand new, with tags, labels and original packaging.
The shipping charges per Retailer will be included in the overall price comparison.
The Price Promise cannot be used in conjunction with any other offer or discount code.
We won't beat our own prices in other market places.
We reserve the right to decline a price promise/beat if it renders the order uncommercial to us.
If you qualify for the price promise/beat we will send you a personal discount code to use which will be valid for 7 days from the date of issue.
We are unable to offer our price promise/beat retrospectively.
For EU Retailers we may consider a price match but cannot beat by 10%. The same criteria applies as detailed above.
It is your responsibility to ensure that you purchase a Helmet that conforms to your local safety standard (e.g. DOT for USA riders and ECE for European Riders).
Helmets are purchased/worn at your own risk and we accept no responsibility for loss or damage to person or property as a result of its use.
We endeavour to display as accurately as possible the colour of products however we cannot guarantee that your monitor/equipment will accurately reflect the colour of the product delivered.
Every effort is made to ensure the accuracy of our Website however some prices and information may change from time to time and it is possible that errors may occur. We will use our best endeavours to rectify any errors as quickly as possible but we cannot be held accountable for any losses incurred.
To the maximum extent permissible by law, we exclude all warranties, expressed or implied as to the accuracy of the information contained in any of the material on the Website. We cannot accept any liability for any particular material on the Website as a result of any use or reliance placed upon the information contained on the Website.

Trade Accounts - Our Terms & Conditions apply to all Trade Orders with the exception of the Returns Policy. We will not accept any returns on Trade orders under any circumstances. Trade orders are defined as ordered and/or delivered to a business address, production/film company or similar.
